1. TERMS AND DEFINITIONS
1.1 Affiliate: Individual or legal entity accepted by BETR9 into the Affiliate Program
1.2 Affiliate Account: Refers to a portal that tracks referrals, provides marketing tools and hosts commission statistics. The Affiliate Account for promoting the website www.betr9.com is managed through the IREV Affiliate.
1.3 Affiliate Agreement: Means all the terms and conditions set out in this document, the terms and conditions of the Commission Structures applicable to the different products and brands, and any other rules or guidelines of the Platform and/or Websites made known to the Affiliate from time to time.
1.4 Affiliate Application: Means the application made by the Affiliate to participate in the Affiliate Program.
1.5 Affiliate Links: Means a unique link issued to the Affiliate for tracking referrals and conversions.
1.6 Affiliate Program: Refers to the marketing partnership offered by BETR9 Partners to approved affiliates.
1.7 Billing: Refers to an online wallet assigned to the Affiliate within the affiliate marketing software corresponding to the relevant Website.
1.8 Affiliate Website: Means any website which is maintained, operated or otherwise controlled by the Affiliate.
1.9 Platform: Shall mean BETR9 Partners or any of its associated companies
1.10 Platform Website: Refers to the website www.betr9.com or other such websites (including mirror websites) as may be added to this Affiliate Program from time to time, operated by Superstars
1.11 Commission: Means percentage of the Net Gaming Revenue, or, where applicable, a fixed amount for a New Customer (CPA structure) as set out in the Commission Structures.
1.12 Commission Structures: Means any specific reward structure expressly agreed between the Company and the Affiliate.
1.13 Confidential Information: Means any information of commercial or essential value relating to the Company.
1.14 Intellectual Property Rights: Means any copyrights, trademarks, service marks, domain names, brands, business names, and registrations of those above.
1.15 "Net Gaming Revenue" or "NGR": Means Gross Revenue generated by Customers, minus Bonuses, Admin Fees (25%), & Chargebacks/Fraud.
1.16 New Customer: Means a FTD (First Time Depositor), which refers to a Customer who registers and makes their first deposit via Affiliate tracking.
1.17 Parties: Mean the Company and the Affiliate (Each a "Party")
1.18 Personal Data: Means any information relating to any person, whether individual or legal, that is or may be identified.
1.19 Sub-Affiliate: Refers to a new Affiliate recruited by a Master Affiliate generating a commission override.
2. AFFILIATE OBLIGATIONS
2.1. Agreement Acceptance
By applying to the Affiliate Program and accepting these terms, the Affiliate agrees to be bound by this Affiliate Agreement. We will, at our sole discretion, determine whether to accept an Affiliate Application. You must provide any documentation required by the Company to verify your application and account information at any time.
2.2. Affiliate Login Details
It is your sole obligation to ensure that login details for your Affiliate Account(s) are always kept confidential and secure. You remain solely responsible for all activity occurring under your account.
2.3. Affiliate Program Participation
The Affiliate Program is intended for your direct participation. Opening an Affiliate Account for a third party, brokering or transferring an Affiliate Account is not accepted. Tracking cookies placed through affiliate links have a duration of 30 days.
2.4. Affiliate Website
You will be solely responsible for the development, operation and maintenance of the Affiliate Website. The Affiliate Website will not contain any defamatory, libelous, discriminatory, violent, obscene, or pornographic materials; false or misleading information, nor will it engage in spam or indiscriminate advertising or anything that leads to Money Laundering in any kind.
2.5. Valid Traffic and Good Faith
You will not generate traffic by registering as a New Customer yourself or benefit from traffic not generated in good faith. Any New Customer found to be a bonus abuser, money launderer or fraudster does not count as valid.
2.6. Unsuitable Websites
You will not place Affiliate Links on unsuitable websites, including those aimed at children, displaying illegal content, promoting violence or discrimination, or violating intellectual property rights.
2.7 Marketing Guidelines
Affiliate Links must be displayed prominently. Masking links is prohibited. E-mail and SMS marketing requires explicit consent and Company approval. Domain names and search terms identical to Company trademarks are prohibited. All advertising creative must be approved by the Company in advance.
2.8. Loyalty Programs
You will not offer any cashback/value-back or similar programs other than those offered on Company Websites.
2.9. Responsible Gambling
You agree to actively cooperate with the Company to convey a responsible gaming message. You will not target persons under 18 or the legal gambling age in their jurisdiction or any other rule that might go against the license we have.
2.10. Additional Obligations
Comply with all laws and avoid targeting restricted jurisdictions. Always comply with GDPR and data protection regulations. Bear all costs and expenses. Provide assistance for monitoring. Return any incorrectly paid commissions immediately upon request.
3. AFFILIATE RIGHTS
3.1. Right to Direct New Customers
We grant you the non-exclusive, non-assignable right to direct New Customers to Company Websites in accordance with the terms of this Agreement.
3.2. License to Use Intellectual Property
We grant you a non-exclusive, non-transferable license to use the Company's Intellectual Property Rights solely in connection with approved promotional materials.
3.3. Players' Personal Data
The Affiliate shall not have access to any Personal Data of the Company's customers.
4. COMPANY OBLIGATIONS
- Provide all digital materials and information required for implementation of Affiliate Links
- Register New Customers and track their transactions
- Make available monitoring tools for tracking commissions
- Process and protect Affiliate personal data in compliance with regulations
- Pay Commission in accordance with the agreement terms
5. COMPANY RIGHTS AND REMEDIES
In case of breach or suspected breach, the Company has the right to:
- Suspend your participation while investigating activities
- Withhold Commission from specific campaigns or traffic in breach
- Withhold monies to cover indemnities or liabilities
- Immediately terminate the Affiliate Agreement
- Withhold monies not withdrawn within 3 months of termination
6. COMMISSION AND PAYMENT
Net Gaming Revenue Calculation:
NGR = (Bets – Wins – Bonuses – Fraud Costs & Chargebacks) – Administration Fee (25%)
Your Commission = NGR × Your Commission Percentage
6.1. Payment Schedule
Commission is calculated at the end of each month, and payments are made monthly in arrears, not later than the 10th of the following calendar month.
6.2. Payment Methods & Minimums
- Withdrawals processed through IREV Affiliates
- Verification documentation may be required for AML compliance purpose
- Minimum withdrawal: $100 USDC for Crypto/Skrill/Neteller, $500 USDC for Bank Wire
6.3. High-Roller Policy
If a Customer generates negative NGR of $10,000 or more in a month (a "High-Roller"), and your aggregated NGR is negative, we may carry forward and offset against future NGR generated by that High-Roller only.
6.4. CPA and Additional Terms
CPA payments made for qualified new customers meeting registration, deposit, and wagering requirements. Fraudulent customers, bonus abusers, and self-excluded players are not qualified. No payment for incentivized traffic or brand bidding. Late converted players qualified within 30 days post-termination (unless terminated for breach). All CPA deals are subject to a 24-hour termination policy.
7. STANDARD COMMISSION STRUCTURES
30% - 0-10 FTD players
35% - 11-20 FTD players
40% - 21-30 FTD players
45% - 31+ FTD players
8. CONFIDENTIAL INFORMATION
All data, strategies, and customer information provided by BETR9 Partners must remain confidential. Affiliates must comply with applicable data protection laws, including GDPR where applicable. This includes ensuring valid consent for marketing communications, maintaining appropriate security measures, and reporting data breaches immediately.
9. TERM AND TERMINATION
9.1. Term
The Agreement begins upon approval and continues unless either Party provides 30 days' written notice of termination. The Company may terminate immediately at any time.
9.2. Actions Upon Termination
Upon termination, you must immediately remove all Company banners/creatives, disable all Affiliate Links, return confidential information, and cease use of all Company Intellectual Property Rights.
9.3. Commission After Termination
All Commission relating to New Customers directed during the term shall not be payable from the date of termination. If terminated due to violation by Affiliate, Company may demand a contractual penalty.
10. MISCELLANEOUS
10.1. Disclaimer
We make no express or implied warranties regarding the Affiliate Program. In case of discrepancy between reports and database, the database shall be deemed accurate.
10.2. Indemnity and Limitation of Liability
You shall indemnify the Company from liabilities resulting from your breach or negligence. The Company shall not be liable for indirect, special, or consequential damages.
10.3. Relationship of Parties
The Company and Affiliate are independent contractors. No partnership, joint venture, or agency relationship is created.
10.4. Modification of Terms
We may modify these terms at any time by posting changes. Continued participation constitutes acceptance of modifications.
